It appears that a woman who attempted to help a boy who fell 4 feet from a rollercoaster after freeing himself from the restrains and died, is claiming for more than $50,000 compensation.
Marion Grant is citing emotional distress and anxiety in her lawsuit filed in the Cook County Circuit Court, Illinois against Go Bananas Indoor Amusement Centre, the Roller Coaster Operator. She claims that she was in the 'zone of danger' with her own children at the time of the accident. The suit cites that Go Bananas "failed to have an attendant operating the machne at all times, operated the roller coaster too fast and didn't have proper harnesses to secure children, also that the ride did not have an emergency stop on the ride."
3 year old twin, Jayson Dansby, fell from the Roller Coaster at around 7pm on the 2nd of April. A post mortem ruled that the boys death was accidental,and determined that he died of multiple injuries sustained from the fall.
The python Pit roller coaster is manufactured by E&F Miler Industries from Portland in Oregon and reaches speeds of just over 15 mph along it's angle iron track.
In a new twist, the family have now launched a lawsuit against Go Bananas for wrongful death. The family lawyers will claim that the ride was unsafe and that it could not be stopped. Patric Salvi said: “To make matters worse, this child died on a children’s amusement park ride … in front of his parents and twin brother. No one should ever have to experience this kind of preventable tragedy.Interestingly enough, the maintenance records on the ride mysteriously disappeared when requested by the police.”
